Travel Packages Terms of Use

These Terms of Use and Travel Services Agreement ("Terms") govern your ("you", "your", "Host", or "user") access to and use of the website at onehundredavenues.com ("Website" or "Company Website"), which is operated by One Hundred Avenues, LLC. ("Company", "One Hundred Avenues", "we", "us", "our"). These Terms also apply to any other products, mobile applications, or platforms provided by the Company (collectively, "Company Programs").

These Terms, along with the Company's Privacy Policy ("Privacy Policy") and any other terms referenced herein, constitute a legally binding agreement ("Agreement") between you and the Company. This Agreement includes essential information about your access to and use of the Website and Company Programs. By accessing or using the Website or any Company Program, you agree to comply with all terms of this Agreement as they appear on the date of your first use. ​The Company reserves the right to modify this Agreement, including terms related to booking a trip or the Privacy Policy ("Updates"), at any time. ​No changes (additions or deletions) made by you to this agreement will be accepted by the Company. If you do not agree to all the terms and conditions of this Agreement, you should not access or use the Website or any other Company Programs.

This Agreement is a binding contract between you and the Company, and it is advisable to download and print the entire Agreement (including these Terms and the Company's Privacy Policy) for your records.


1. Definitions

"Company" refers to One Hundred Avenues LLC, the provider of travel packages. "Customer" refers to the individual purchasing a travel package and/or the traveler. "Travel Package" means the pre-arranged travel services including transportation, accommodation, activities, and related services offered by the Company. "Financing Option" refers to the third-party payment plans available through financial institutions the Company uses to collect payments from the Customer.


2. Booking and Payment

Customers must be 18 years or older to purchase a travel package. Once all necessary information is collected, the Company will send an invoice along with a personalized checkout link. Financing is provided through third-party financial institutions, as the Company does not handle financing directly. Payment terms and credit approval are determined by these external financial institutions. Customers are responsible for understanding and adhering to the payment schedule. Failure to make timely payments may result in additional fees, impact on credit score, and potential cancellation of the travel package.


3. Package Modifications and Cancellations

Customers may modify their package by changing the duration of stay or modifying up to two activities within the package. Changes are subject to the condition that new activities must be within the same geographic area to ensure smooth travel logistics, and pricing will be adjusted accordingly based on modifications. Cancellations must be communicated to the Company as soon as possible. Due to pre-payments for accommodations, activities, and transportation, no refunds will be issued within 60 days of the scheduled check-in date. Customers may receive a credit to reschedule for a future date. All approved cancellations are subject to a $300 travel planning and administration fee. Cancellation and change fees may apply based on specific package details.

 
4. Travel Requirements and Limitations

Some activities may have age restrictions for safety reasons. Customers are strongly advised to review package details carefully and consult with the Company's team to ensure all group members can participate in planned activities. The Company provides curated restaurant suggestions but does not manage restaurant reservations or include meals in travel packages, allowing travelers to enjoy dining experiences tailored to their individual tastes and budgets. Customers are responsible for ensuring they have valid travel documents, including passports, visas, and required vaccinations. The Company is not liable for denied entry or travel restrictions. Travel insurance is strongly recommended and not included in the package price. Customers are encouraged to purchase comprehensive travel insurance to cover medical emergencies, trip cancellations, and other unforeseen circumstances. Customers are responsible for ensuring compliance with all applicable laws and regulations in relation to their travel and use of our services. The Company is not liable for any legal issues or penalties resulting from non-compliance.

The Company is not liable for any injuries, losses, damages, or negative experiences that occur during your trip. By participating in the travel package, you acknowledge and assume all risks associated with travel, including but not limited to accidents, delays, losses, illnesses, theft, or any other unforeseen events. You agree that the Company is not responsible for any claims arising from such occurrences.


5. Health, Safety, and Insurance

5.1 Health Requirements and Disclosures

Travelers must fully disclose all medical conditions, dietary restrictions, allergies, disabilities, and any other health-related matters that may affect their participation in travel package activities prior to booking. This includes both physical and mental health conditions that could impact the traveler's ability to fully engage in scheduled activities or that may require special accommodations. The Company will make reasonable accommodations where possible and within our capability, but is not liable for any health issues, complications, or injuries arising during the trip. Travelers are solely responsible for bringing and administering any necessary medications, medical equipment, or health-related items needed during their travel. The Company reserves the right to require medical clearance documentation from a licensed healthcare provider before allowing participation in certain activities. Failure to disclose relevant health information may result in the cancellation of travel arrangements without a refund.

5.2 Safety Protocols and Procedures

Safety is our highest priority during all travel package activities. All travelers must attend any required safety briefings and strictly adhere to all provided safety guidelines, instructions, and protocols. The Company reserves the right to immediately terminate travel arrangements for any traveler who violates safety protocols or whose behavior poses a risk to themselves or others, without refund or compensation. In case of emergency, established emergency procedures must be followed precisely as directed by local staff or authorities. Any accidents, injuries, near-misses, or safety concerns must be reported immediately to local staff for proper documentation and response. The Company maintains the right to modify or cancel any activity or itinerary if conditions are deemed unsafe. Travelers must comply with all local health and safety regulations, including any applicable public health requirements in effect during their travel.

5.3 Insurance Requirements and Recommendations

We strongly recommend that all travelers obtain comprehensive travel insurance coverage prior to departure. This insurance should include coverage for trip cancellation, medical emergencies, emergency evacuation, and personal property loss or damage. The Company is not responsible for personal property loss, damage, or theft during the trip, including but not limited to luggage, electronic devices, jewelry, or other valuables. Travelers should ensure their insurance provides adequate coverage for all planned activities, including any adventure or physical activities included in the travel package. International travelers should ensure their insurance coverage is valid in all destination countries and includes medical evacuation coverage if needed. Travelers are responsible for reviewing and understanding their insurance coverage and any applicable exclusions or limitations.

5.4 Physical Requirements and Activity Levels

Each travel package has specific physical requirements and activity levels that travelers must be able to meet. The Company will provide general information about the physical demands of included activities, but it is the traveler's responsibility to honestly assess their ability to safely participate. Some activities may require specific physical capabilities, such as the ability to walk certain distances, swim, or maintain balance. Travelers should carefully review all activity descriptions and requirements before booking. The Company reserves the right to exclude travelers from specific activities if their physical condition appears to pose a safety risk, as determined by our representatives or activity providers.

5.5 Environmental and Location-Specific Considerations

Travelers must be prepared for the environmental conditions at all destinations, which may include high altitudes, extreme temperatures, or remote locations with limited medical facilities. The Company will provide information about relevant environmental considerations, but travelers are responsible for ensuring they are properly prepared and capable of handling these conditions. This includes bringing appropriate clothing, equipment, and supplies. Travelers with known sensitivities to environmental factors (such as altitude, heat, or cold) should consult with their healthcare provider before booking.

5.6 Medical Emergencies and First Aid

While the Company will make reasonable efforts to assist in medical emergencies, travelers acknowledge that some destinations may have limited access to immediate medical care and treatment for serious medical conditions may require evacuation to appropriate medical facilities. The cost of emergency medical treatment or evacuation is the traveler's responsibility. Travelers must provide emergency contact information and relevant medical history before departure. In the event of a medical emergency, the Company is authorized to obtain emergency medical treatment for the traveler at their expense.

 
6. Liability and Limitations

The Company acts solely as an agent for the various independent suppliers that provide services in connection with our packages. We are not responsible for the performance of any third-party service providers. The Company is not liable for any delays, losses, cancellations, or changes caused by third-party services, acts of God, natural disasters, political unrest, or other circumstances beyond our control. The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from or related to your use of the Website or Company Programs or Services, even if advised of the possibility of such damages. Our total liability shall not exceed the amount paid by you for the travel package. You agree to indemnify and hold harmless the Company, its affiliates, and their respective directors, officers, and employees from any claims, liabilities, damages, or expenses arising from your use of the Website or Company Programs, or your violation of this Agreement.


7. Termination

The Company reserves the right to terminate your access to the Website or any Company Programs at its sole discretion, without notice, if you violate any terms of this Agreement or engage in any fraudulent or unlawful activities. The Company employs measures to detect and prevent fraud. Any suspected fraudulent activity will be investigated, and appropriate legal action will be taken, including notifying law enforcement.

 
8. Privacy and Data Protection

Customer data is collected and processed in accordance with our Privacy Policy. Payment information is securely processed by Stripe and subject to their privacy and security protocols. By booking a travel package, customers consent to the collection and use of their personal information for booking and communication purposes. All content, trademarks, and data on the Website, including but not limited to software, databases, text, graphics, icons, and hyperlinks, are the property of or licensed to the Company and are protected by law. Unauthorized use of this material is prohibited.

 
9. Modifications to Terms

The Company reserves the right to modify these terms and conditions at any time. Current terms will be available on our website.


10. Governing Law

These terms and conditions are governed by the laws of Florida, United States of America. Any disputes arising out of or relating to this Agreement shall be resolved through binding arbitration in Florida, United States of America, in accordance with the rules of the American Arbitration Association. The decision of the arbitrator shall be final and binding on both parties.
