Retreats Terms & Conditions


These Terms and Conditions ("Terms") govern your participation in travel retreats ("Retreats") offered through One Hundred Avenues, LLC ("Company", "we", "us", "our") and hosted by independent influencers ("Hosts"). By booking a Retreat, you agree to these Terms. For information regarding our privacy practices, please refer to our Privacy Policy on our website.


PLEASE READ THESE TERMS CAREFULLY:

These Terms constitute a legally binding agreement between you and the Company. By booking a Retreat, you agree to comply with all terms as they appear on the date of booking. The Company reserves the right to modify these Terms at any time. No changes made by you to this agreement will be accepted by the Company.


1. Definitions

For purposes of these Terms, "Host" or "Retreat Host" refers to the influencer, individual, or business hosting a Retreat. A "Traveler" or "Retreat Participant" means any person who books and/or attends a Retreat. "Trip" or "Retreat" describes the scheduled itinerary with specified host, dates, and price. A "Trip Credit" is a voucher valid for 6 months, while "Reschedule" refers to the postponement of the Trip, to be rescheduled within 12 months. "Cancellation" means any significant date change or removal from sale. "Force Majeure" refers to unforeseeable circumstances preventing fulfillment of the contract.


2. Eligibility and Participation Requirements

All participants must meet certain basic requirements to participate in our retreats. Participation is limited to individuals who are at least 18 years of age and possess valid travel documentation. Prior to booking, participants must disclose any medical conditions and dietary restrictions that may affect their ability to participate in retreat activities.

Participants are expected to follow all retreat schedules and guidelines while maintaining appropriate behavior throughout the retreat. Each participant is responsible for ensuring their personal fitness level meets retreat requirements and obtaining necessary travel insurance. Compliance with all local laws, regulations, and health and safety protocols is mandatory.


3. Cancellation, Refund, and Changes Policy

Our standard Retreat cancellation policy allows cancellations up to 15 days before check-in. A cancellation fee of $100 plus 6% non-refundable fee of the total package price applies to all cancellations. No refunds will be issued for no-shows, and participants should note that exchange rate fluctuations may affect refund amounts.

A "Covered Event" is defined as a medical condition preventing participation in the retreat. To qualify, written notice must be provided within 48 hours of diagnosis, accompanied by documentation from a licensed medical professional. In such cases, participants may either reschedule without penalty (subject to availability) or cancel with standard fees applying ($100 plus 6% of package price).

The Company and Hosts reserve the right to modify itineraries due to unforeseen circumstances. Participants will be notified of significant changes, and alternative arrangements will be offered when possible. In cases of Force Majeure, the Company is not liable for delays, losses or failures, but rescheduling options will be provided within 12 months, and standard cancellation fees may be waived.


4. Health, Safety, and Insurance

4.1 Health Requirements and Disclosures

Participants must fully disclose all medical conditions, dietary restrictions, allergies, disabilities, and any other health-related matters that may affect their participation in retreat activities prior to booking. This includes both physical and mental health conditions that could impact the participant's ability to fully engage in scheduled activities or that may require special accommodations. The Company and Hosts will make reasonable accommodations where possible and within our capability, but they are not liable for any health issues, complications, or injuries arising during the retreat. Participants are solely responsible for bringing and administering any necessary medications, medical equipment, or health-related items needed during the retreat. The Company reserves the right to require medical clearance documentation from a licensed healthcare provider before allowing participation in certain activities. Failure to disclose relevant health information may result in removal from the retreat without a refund.

4.2 Safety Protocols and Procedures

Safety is our highest priority during all retreat activities. All participants must attend any required safety briefings and strictly adhere to all provided safety guidelines, instructions, and protocols. The Company and Hosts reserve the right to immediately remove any participant who violates safety protocols or whose behavior poses a risk to themselves or others, without refund or compensation. In case of emergency, established emergency procedures must be followed precisely as directed by retreat host or local authorities. Any accidents, injuries, near-misses, or safety concerns must be reported immediately to retreat host for proper documentation and response. The Company maintains the right to modify or cancel any activity if conditions are deemed unsafe. Participants must comply with all local health and safety regulations, including any applicable COVID-19 or other public health requirements in effect during the retreat.

4.3 Insurance Requirements and Recommendations

We strongly recommend that all participants obtain comprehensive travel insurance coverage prior to the retreat. This insurance should include coverage for trip cancellation, medical emergencies, emergency evacuation, and personal property loss or damage. The Company and Hosts are not responsible for personal property loss, damage, or theft during the retreat, including but not limited to luggage, electronic devices, jewelry, or other valuables. Participants should ensure their insurance provides adequate coverage for all planned activities, including any adventure or physical activities included in the retreat itinerary. International participants should ensure their insurance coverage is valid in the retreat's location and includes medical evacuation coverage if needed. Participants are responsible for reviewing and understanding their insurance coverage and any applicable exclusions or limitations.

4.4 Physical Requirements and Activity Levels

Each retreat has specific physical requirements and activity levels that participants must be able to meet. The Company will provide general information about the physical demands of retreat activities, but it is the participant's responsibility to honestly assess their ability to safely participate. Some activities may require specific physical capabilities, such as the ability to walk certain distances, swim, or maintain balance. Participants should carefully review all activity descriptions and requirements before booking. The Company or Host reserves the right to exclude participants from specific activities if their physical condition appears to pose a safety risk, as determined by retreat staff or activity providers.

4.5 Environmental and Location-Specific Considerations

Participants must be prepared for the environmental conditions at the retreat location, which may include high altitudes, extreme temperatures, or remote locations with limited medical facilities. The Company will provide information about relevant environmental considerations, but participants are responsible for ensuring they are properly prepared and capable of handling these conditions. This includes bringing appropriate clothing, equipment, and supplies. Participants with known sensitivities to environmental factors (such as altitude, heat, or cold) should consult with their healthcare provider before booking.

4.6 Medical Emergencies and First Aid

While the Company and Hosts will make reasonable efforts to assist in medical emergencies, participants acknowledge that retreats may take place in locations with limited access to immediate medical care and treatment for serious medical conditions may require evacuation to appropriate medical facilities. The cost of emergency medical treatment or evacuation is the participant's responsibility. Participants must provide emergency contact information and relevant medical history before the retreat begins. In the event of a medical emergency, the Company and Hosts are authorized to obtain emergency medical treatment for the participant at their expense.

5. Intellectual Property and Media

All retreat concepts and materials are owned by the Company, while Hosts retain rights to their personal content. The Company is licensed to use Host content for promotional purposes, but participants may not use retreat materials for commercial purposes without explicit permission.

By participating in our retreats, participants consent to the use of photos and videos taken during the retreat for promotional purposes by both the Company and Hosts. Participants who wish to opt out must provide written notice before the retreat begins. While personal use of retreat photos by participants is permitted, commercial use is prohibited without express authorization.

6. Liability and Legal Matters

The Company's liability is limited regarding personal injury, property damage, third-party service providers, Force Majeure events, travel delays or cancellations, and lost or stolen items. Hosts and Participants must indemnify the Company against claims arising from personal injury, property damage, violations of these Terms, legal violations, and third-party claims.

All parties agree to a non-disparagement clause, prohibiting the making of defamatory statements about the Company or its services. While constructive feedback through official channels is encouraged, violation of this provision may result in immediate termination of the relationship.

7. Dispute Resolution

All disputes arising from these Terms shall be governed by Florida law, with exclusive jurisdiction in Florida courts. Class actions are prohibited, and individual arbitration is required for dispute resolution. Legal proceedings must begin with written notice of claims, followed by a 30-day informal resolution period. If necessary, arbitration will take place in Florida, with each party bearing their own legal costs.

8. Confidentiality

Protected information includes business practices and methods, pricing and financial information, participant and host information, and proprietary materials. All parties must maintain strict confidentiality of this information, using it only for retreat purposes. Upon request, confidential materials must be returned or destroyed, and any unauthorized disclosures must be reported immediately.

9. Updates and Modifications

The Company may modify these Terms at any time, providing notice when practical. Continued participation following any modifications implies acceptance of the updated Terms. We recommend reviewing these Terms before each retreat participation. If any provision is found to be invalid, the remaining terms will maintain their effect, with interpretation favoring enforceability.
